A magistrate has refused to excuse a man charged with attempted murder from his next court appearance.

Shane Russell Smith, 50, is charged with causing wounding or grievous bodily harm with the intention to murder, causing grievous bodily harm while driving dangerously and driving recklessly and/or furiously.
Smith was present in Batemans Bay Local Court on Monday, November 25, but the court heard the prosecution brief was delayed, awaiting evidence from the alleged crime scene.
The case was adjourned to Monday, December 2 in Batemans Bay and defence solicitor Geoff Knox requested his client be excused from again travelling from Merimbula.
Magistrate Mark Douglass disagreed.
"It is an important day in this process," Magistrate Douglass told the accused.
"The charges will be here and you will have to be here."
